Bruce Pomerantz Disclosures: BrokerCheck, FINRA, And SEC ReportsEvery complaint, disclosure, litigation against Bruce Pomerantz

The disclosure of client grievances and arbitrations, regulatory actions, job terminations, bankruptcy filings, and criminal or civil legal procedures is a requirement for anyone registered to offer securities or give investment advice.

Below is a description of the sort of disclosure event involved:

  • The client accused the seller of selling several municipal bonds of negligence, fraud, and contract violations. The complaint alleged negligence, fraud, and other offenses, and the claim was for $60,000 plus attorney’s fees.
  • Breach of Agreement relating to the sale of a number of municipal bonds. The claim was for $60,000.00 in addition to legal costs. Nine months after issuance, the issuer called bonds early.
  • The client claims, via an attorney, that FA improperly persuaded the client to get a loan with security-based collateral in order to pay for the purchase of a cooperative apartment. (04/01/2014-11/10/2014)
Financial Advisors often take down their client disputes from FINRA’s Public database through Disclosure Expungement. Even law firms provide expungement services to FAs so that they can hide or remove their client disputes and maintain a clean record. So the lack of any disclosures on BrokerCheck doesn’t necessarily mean that the broker hasn’t had any disputes in the past.
